SafeNav Terms of Service

These terms govern your use of the SafeNav mobile app and this website (together, "SafeNav"). SafeNav is operated by Yixiao Qu, trading as NQ Labs (ABN held in Australia).
By downloading, installing, or using SafeNav you accept these terms. If you do not accept them, do not use SafeNav.
1. What SafeNav is
SafeNav is a free navigation app for drivers in Australia that highlights right turns and crossings it considers risky based on road classification and OpenStreetMap data, and offers rerouted alternatives.
SafeNav is a driving aid, not a replacement for your own judgement. Road conditions change, data can be wrong or out of date, and some risks cannot be detected from map data alone. You are always responsible for how you drive. Always obey road rules, road signs, traffic signals, and any instructions from emergency services, even if they contradict the app.
SafeNav is not an emergency service. Do not rely on it in an emergency. Call 000 if you need emergency assistance.
2. Who can use it
SafeNav is intended for licensed drivers in Australia aged 18 or over, or for passengers using the app under the supervision of a licensed driver. SafeNav is not directed at children under 13 and we do not knowingly collect information from them.
3. Acceptable use
When you use SafeNav you agree not to:
- Use it in a way that breaks any law, including road rules.
- Use it to harass, defraud, or endanger other people.
- Reverse engineer, decompile, or attempt to extract source code from the app, except to the extent allowed by law.
- Probe, scan, or attack our servers, or send automated or abusive traffic to them.
- Resell, repackage, or redistribute SafeNav's routes, data, or functionality without our written permission.
- Remove, obscure, or alter attribution notices (including OpenStreetMap and Mapbox credits).
We may suspend or terminate your access if you materially breach these rules.
4. App stores and payment
SafeNav is distributed through Apple's App Store. Your use of the App Store is also subject to Apple's terms. SafeNav itself is free at launch; if we introduce paid features in the future, those features will be offered through the App Store and you'll be shown the terms before you pay.
5. Third-party services
SafeNav uses third parties to deliver map tiles, routing, search suggestions, crash reports, and hosting. These providers have their own terms and privacy policies. By using SafeNav you also accept the applicable terms of:
- Mapbox — mapbox.com/legal/tos
- Google (Places API) — policies.google.com/terms
- Sentry — sentry.io/terms
- Google Cloud Platform — cloud.google.com/terms
- OpenStreetMap contributors (map data, ODbL licensed) — openstreetmap.org/copyright
If a third-party provider's service is disrupted, SafeNav's functionality may be affected.
6. Intellectual property
The SafeNav name, logo, website, and app — excluding third-party map data and libraries — belong to NQ Labs. You may not use our name or logo to suggest endorsement without permission. Open-source components are licensed under their respective licences; see the app's About screen for a complete list once launched.
7. Disclaimers
SafeNav is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties that:
- the app will be uninterrupted, secure, or error-free;
- the safety analysis will detect every dangerous intersection;
- routes will be the fastest, shortest, or even routable at all times;
- third-party services used by the app will be available.
You use SafeNav at your own risk.
8. Limitation of liability
To the extent permitted by law, NQ Labs will not be liable for any indirect, incidental, consequential, or special damages arising from your use of SafeNav, including loss of time, fuel, data, or profit. Our aggregate liability for any direct loss is limited to AUD $50 or the amount you have paid us in the preceding twelve months, whichever is greater.
Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded. If SafeNav fails to meet a guarantee under the ACL that cannot be limited, our liability is limited to re-supplying the app or refunding the amount you paid.
9. Indemnity
You agree to indemnify NQ Labs against any claim arising from your breach of these terms or your misuse of SafeNav — for example, using the app in a way that is illegal or in breach of section 3.
10. Changes
We may update these terms from time to time. Material changes will be surfaced in-app or on this page with an updated "Last updated" date. Continued use of SafeNav after the changes take effect means you accept the new terms.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. You agree to the exclusive jurisdiction of the courts of New South Wales, subject to any mandatory consumer-protection rights you may have in your own state or country.
